By accessing or using Phonecall ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Phonecall provides an internet-based international calling service that allows you to make phone calls to landline and mobile numbers worldwide through your web browser. The Service requires an internet connection and a compatible web browser.

3. Account Registration

To use the Service, you must:

  • Create an account using a valid email address or Google account
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Accept responsibility for all activities under your account

4. Payment and Billing

4.1 Prepaid Credits

The Service operates on a prepaid credit system. You must add credits to your account before making calls. Credits are charged per minute based on the destination and type of number (mobile or landline).

4.2 Rates

Call rates are displayed before each call and are subject to change. Rates vary by destination country and number type. You are responsible for reviewing rates before initiating calls.

4.3 No Refunds

All purchases of credits are final. Credits do not expire but are non-refundable except as required by law. Unused credits remain in your account until used.

4.4 Billing Disputes

If you believe you have been charged incorrectly, you must contact us within 30 days of the charge. We will investigate and resolve disputes in good faith.

5. Acceptable Use

You agree not to use the Service:

  • For any illegal purpose or in violation of any laws
  • To transmit spam, unsolicited messages, or harassing communications
  • To impersonate any person or entity
  • To interfere with or disrupt the Service or servers
  • To attempt to gain unauthorized access to any part of the Service
  • To use automated systems to make calls without authorization
  • For any fraudulent or deceptive purpose

6. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues
  • Force majeure events
  • Third-party service provider issues

We are not liable for any loss or damage resulting from Service unavailability.

7. Call Quality

Call quality depends on your internet connection and the destination network. We do not guarantee call quality and are not responsible for:

  • Call drops or interruptions
  • Audio quality issues
  • Failed call connections
  • Network-related problems

8. Termination

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Use the Service for illegal purposes
  • Fail to pay for services

You may terminate your account at any time. Upon termination, your access to the Service will cease, but unused credits may remain in your account subject to our refund policy.

9. Intellectual Property

The Service, including its design, features, and content, is owned by Phonecall and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHONECALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Phonecall, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kingdom of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Kingdom of the Netherlands.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
